Responsibility of the Publisher

Nature of the Publisher’s Obligations
The Publisher is committed to providing quality products that meet the specifications outlined in these Terms and Conditions. The Publisher is only responsible for fulfilling obligations relating to the services described in these terms.

Force Majeure - Client’s Fault
The Publisher shall not be held liable in cases of force majeure or fault on the part of the Client, as defined in this article:

Force Majeure
Force majeure events include, but are not limited to, fire, epidemics, explosions, earthquakes, bandwidth fluctuations, failures attributable to the internet service provider, network failures, facility collapse, unauthorized or fraudulent use of passwords, codes, or references provided to the Client, hacking, security breaches by the website host or developers, flooding, power outages, war, embargoes, laws, orders, or any government requirements, requisitions, strikes, boycotts, or other circumstances beyond the reasonable control of the Publisher. In such cases, the Publisher is exempt from fulfilling its obligations to the extent of the hindrance, limitation, or disruption.

Client’s Fault
The Publisher will not be held responsible for any misuse of the Service by the Client, negligence, omissions, or failure on the part of the Client or their representatives, non-compliance with guidance provided by the Publisher on the website, illegal disclosure or use of the Client’s password, codes, and references, or the provision of incorrect information or failure to update personal details. Any technical process, such as the use of robots or automated queries, which contravenes the terms of these general sales conditions, will also be considered the Client’s fault.

Technical Issues - Hyperlinks
If the website is inaccessible due to any technical issues, the Client cannot claim damages or compensation. The unavailability, even for extended periods, of one or more online services will not constitute harm for the Client and will not entitle the Client to compensation from the Publisher.

Hyperlinks on the website may link to other websites. The Publisher is not responsible for the content of these external sites if they violate applicable laws. Additionally, the Publisher will not be liable for any harm caused to the Client from visiting these external sites.

Given current technological constraints, the visual representation of the products on the site (such as colors or shapes) may vary between different devices and may differ from reality depending on the display quality and screen resolution. These variations cannot be attributed to the Publisher, who will not be liable for such discrepancies.

Damages and Liabilities of the Publisher
Unless otherwise specified by law or regulation, the Publisher's liability is limited to the direct, personal, and certain harm suffered by the Client as a result of the failure in question. The Publisher will not be liable for indirect damages, such as data loss, commercial losses, loss of orders, damage to reputation, commercial disturbances, or loss of profits or clients. In any case, the damages payable by the Publisher will not exceed the price of the ordered product.

Hyperlinks and Content of the Site
The content, including images, photographs, and videos, on the site is provided for informational purposes only and without any guarantee of accuracy. The Publisher cannot be held liable for any omissions, inaccuracies, or errors in this content that could lead to direct or indirect harm to the Client.

Intellectual Property

Legal Protection of Website Content
The content on the site may be protected by copyright and database rights. Any unauthorized reproduction, representation, translation, adaptation, or transformation, whether in whole or in part, without the Publisher's consent, constitutes a violation of the French Intellectual Property Code and may result in legal actions for infringement.

Contractual Protection of Website Content
The Client agrees, by accessing the site, not to use, reproduce, or represent the website content in any form for purposes other than reading by a browser or robot. This prohibition does not apply to indexing robots, whose sole purpose is to scan the site content for indexing purposes.
